THE SUPREME COURT OF INDONESIA IN FAVOUR OF PT GUNUNGBAYAN PRATAMACOAL AND DISMISSED THE CESSATION PETITION OF ABDUL SOKENG AND PARTNER

Jakarta, April 30, 2009 – PT Bayan Resources Tbk announces the ruling of the Supreme Court in favour of PT Gunungbayan Pramatacoal (GBP) and has dismissed the cessation petition of Abdul Sokeng (“plaintiff”).
 

The civil suit was brought against GBP in the District Court of Tenggarong (“DC”) for IDR 1.66 trillion in damages. GBP was alleged to have failed to compensate the Plaintiff for the exploitation and destruction of the Plaintiff’s land. The DC ruled in favour of GBP and determined that the Plaintiff had no legal claim. The Plaintiff appealed the DC’s decision to the High Court of East Kalimantan which upheld the DC’s decision. Subsequently, the Plaintiff submitted a cessation petition to the Supreme Court and this was also dismissed by the Supreme Court and ruled in favour of GBP.
