Jakarta, August 21, 2008 – The South Jakarta district court held the first hearing today for the lawsuit filed by Haji Asri, Muhammad Abduh, and Muhammad Rasyid Ridha against PT Kaltim Bara Sentosa (first defendant) Low Tuck Kwong (second defendant), Hengki Wibowo (third defendant), PT International Coal Pte Ltd (co-defendant I) and PT Bayan Resources Tbk (co-defendant II). The lawsuit was filed because the plaintiff claimed that the share purchasing contract of PT Gunung Bayan Pratama Coal dated November 27, 1997 was illegal because it was made under pressure from the Department of Mining.

 

Responding to the lawsuit, PT Bayan Resources Tbk. (Bayan)’s attorney, Richard Chandra Adam, clarified that the lawsuit has no legal basis and is unreasonable. According to Richard, Bayan was established in 2004 based on Bayan’s Deed of Establishment no. 12, dated 7 October 2004. This means Bayan as a legal entity did not exist when the share purchasing contract was signed on November 27th 1997.
